Order on Board 07.10.2026
1. The applicant has preferred this First Bail Application under Section 483 of the BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 178/2026, registered at Police Station Purani Basti, Raipur (C.G.) for the offence punishable under Sections 333, 74 and 305 of BNS and 10 of POCSO Act.
2. The case of the prosecution, in brief, is that on 21.04.2026, the complainant lodged an FIR at Police Station Purani Basti, alleging that an unknown person had entered her house when
2 her six-and-a-half-year-old niece (victim) and son were present there. On being questioned, the victim disclosed that the said person had made her sit on his lap and touched her chest. The complainant also found that her Vivo mobile phone was missing. On the basis of the report, Crime No. 178/2026 was registered, and after completion of the investigation, the charge-sheet was filed against the accused for the offences as stated above.
3.
Learned counsel appearing for the applicant submits that the applicant has been falsely implicated in the present case and that the allegations levelled against him are false and baseless. He further submits that the applicant is innocent and that the charge- sheet has already been filed and he is in jail since 22.04.2026. He, therefore, prays for grant of bail to the applicant.
4. Learned State Counsel would oppose the bail application and submit that the victim is a minor girl aged about six and a half years and has made specific allegations against the present applicant. He further submits that the CCTV footage corroborates the presence of an unknown person in the house and that the applicant is accused of committing serious offences. He, therefore, prays for rejection of the bail application.
5. In pursuance of the notice dated 02.09.2026 issued to the victim, today the victim along with her mother appeared before this Court through video conferencing from concerned DLSA and have raised serious objection in releasing the applicant on bail.

6. I have heard the learned counsel for the parties and perused the case diary.
7. Having considered the facts and circumstances of the case, particularly the fact that the victim is a minor girl aged about six and a half years and has made specific allegations of sexual misconduct against the present applicant, the nature and gravity of the alleged offences, and the serious objection raised by the victim and her mother to the release of the applicant on bail, I do not find any good ground to enlarge the applicant on bail. Accordingly, the bail application filed by the applicant is rejected. Sd/- (Rakesh Mohan Pandey)
