JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Crime No.60/2026 registered by Kolala Police Station, Tumakuru District for the offences punishable under Sections 74, 189(2), 191(3), 115(2), 118(1), 329(3), 324(4), 351(2), 352 and 190 of the Bharatiya Nyaya Sanhita (BNS), 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the arguments of the learned counsel for the parties. 3. FIR in Crime No.60 /2026 was registered by Kolala Station for the aforesaid offences against the petitioner and others, based on the first information dated - 3 - HC-KAR CNR: KAHC010567192026 NC: 2026:KHC:48246 CRL.P No. 12499 of 2026 13.07.2026 received from Smt. Radha R., W/o Lokesh. Apprehending arrest in the said case, the petitioner had filed Crl. Misc. No. 5266/2026 before the jurisdictional Sessions Court which was rejected against him on 03.08.2026. Therefore, he is before this Court. 4. A perusal of the material on record would go to show that, there is some civil dispute between the family of the accused persons and the family of the injured victim in the present case. It is in this background, on 12.07.2026 at about 02:00 p.m., accused persons, after abusing the first informant and her family members, allegedly had assaulted them. In the first information it is stated that, the petitioner who had quarreled with the victim lady, had touched her chest inappropriately and also had pulled her dress, and tried to outrage her modesty. 5. The material on record would go to show that, the first informant and three others have suffered injuries - 4 - HC-KAR CNR: KAHC010567192026 NC: 2026:KHC:48246 CRL.P No. 12499 of 2026 in the incident. Except Lokesh, who is the husband of the first informant, the other three victims have suffered only simple injuries in the incident. Lokesh has suffered a fracture injury as a result of assault made by accused No.1 and accused No.4 Manjula on his head with wooden clubs. 6. Accused No.4 Manjula had been granted anticipatory bail in the present case by the jurisdictional Sessions Court. Allegations made as against the petitioner and accused No.4 Manjula are similar. It is not in dispute that, the petitioner had no criminal antecedents and he is an agriculturist by avocation. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner seeking anticipatory bail needs to be granted, subject to appropriate conditions. Accordingly, the following: ORDER (i) The petition is allowed. - 5 - HC-KAR CNR: KAHC010567192026 NC: 2026:KHC:48246 CRL.P No. 12499 of 2026 (ii) The respondent - Police or any other Police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.60/2026 registered by Kolala Police Station, Tumakuru District for the offences punishable under Sections 74, 189(2), 191(3), 115(2), 118(1), 329(3), 324(4), 351(2), 352 and 190 of BNS, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
