ORAL ORDER
Aggrieved by the order passed on I.A.No.4 to 6 in Com.OS.No.02/2023 dated 25.11.2025 by the Principal District and Sessions Judge, Ramanagara, the defendant is before this Court. The defendant has filed a written statement beyond 120 days, and the trial Court has refused to receive the same.
2. Learned counsel appearing for the petitioner submits that the plaint was not served on the defendant. As such, there is a delay in filing the written statement.
3. Learned counsel appearing for the respondents submits that, in light of the settled law, written statement filed beyond

120 days cannot be considered, and the Court has no such power in light of the settled law.
4. Having heard the learned counsels on either side, perused the material on record. As far as filing of the written statement beyond 120 days is concerned, the law is well settled. The Court has no power to condone the delay and to take the written statement on record. In those circumstances, this Court do not find any reasons to interfere.
5. Accordingly, this Court is passing the following:
ORDER i. The writ petition is dismissed. ii. Pending I.As in the petition shall stand closed.
