ORAL ORDER
1. Accused Nos.1 and 2 in Crime No.185 of 2026 registered by Amruthahalli Police Station, Bengaluru City for offences punishable Under Sections 318(4), 351(2) r/w Section 3(5) of BNS, 2023 are before this Court in this petition filed under Section 483 of BNSS, 2023 seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.185 of 2026 was registered by Amruthahalli Police Station, Bengaluru City for the aforesaid offences against the petitioners herein and another, based on the first information dated 18.06.2026 received from Sri Saurabh gain. Apprehending arrest in the said case, the petitioners had approached the jurisdictional Sessions Court in

Crl.Misc.No.6450 of 2026 which was rejected on 18.07.2026. Therefore they are before this Court.
4. The first informant appears to be the authorized representative of alleged victim, who is citizen of Thailand. Allegation in the first information is that when the alleged victim was in custody in India for the reason that she had stayed in India without valid documents, she had given the key of her apartment to the accused persons, who allegedly had taken all valuables from her apartment and also the advance amount of Rs.40,000/-. given to the owner of the apartment and when the first informant contacted the accused, they criminally intimidated him. The victim lady has not approached the police and on the other hand, the first informant claims to be the representative of victim lady. Petitioners hail from Uttar Pradesh and West Bengal and the allegation against them is that for the purpose of cleaning an apartment in Bengaluru, the key of the said apartment was handed over to them by the victim lady who is now in Thailand.

5. Considering the nature of allegation found against the petitioners in the first information, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following:-
ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.185 of 2026 registered by Amruthahalli Police Station, Bengaluru City for offences punishable Under Sections 318(4), 351(2) r/w Section 3(5) of BNS, 2023, subject to the following conditions:
1. The petitioners shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court.

2. The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. The petitioners shall not tamper with the prosecution witness and they shall co-operate with the Police for investigation and appear before them whenever called upon.
4. The petitioners shall not involve in similar offences in future.
