Learned advocate for the petitioners submits that the petitioners have been foisted with the present criminal case and another co-accused has already been granted anticipatory bail. So far as the present petitioners are concerned, their complicity is more or less similar to the other accused person who has been granted anticipatory bail. State has produced the report which reflects that so far as the petitioner no.1 is concerned, against him, 21 cases are pending which includes the cases under the Arms
2 Act, dacoity, NDPS Act, MPO Act, PDPP Act and similar other grievous offences. So far as the petitioner no.2 is concerned, there are five criminal cases pending against him, which includes a case under section 302 of the IPC; two NDPS cases; one case for dacoity and Arms Act and one case under the Arms Act. Having considered the antecedents of the present petitioners, I am of the opinion that this is not a fit case for granting anticipatory bail to the present petitioners. Hence, the prayer for anticipatory bail of the petitioner is Rejected. Accordingly, CRM (A) 936 of 2026 is dismissed. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
