… Petitioner(s)
Md. Wasim Akram Ms. Sabrina Parveen
… for the petitioner(s)
Mr. Ramashis Mukherjee Mr. Avishek Bhandari
… for the State-respondent(s)
Learned advocate for the petitioner submits that there has been change of circumstances, as such, there is no need of custodial deentionof the present petitioner. It is also submitted that charge-sheet has already been submitted before the learned jurisdictional court. State has produced the case diary. I have taken into account the statement therein as well as the medical report. However, charge-sheet reflects that it is not only a case of matrimonial dispute but also consumption of poisonous substances is there.
2 Having regard to the fact that the case was registered in the year 2023 as also the fact that the prosecution’s case presently cannot be disbelieved, taking into account the merits of the case, I am of the opinion that this is not a fit case for granting anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Rejected. However, in case, the petitioner appears before the learned jurisdictional court and is able to demonstrate that there has been change of circumstances, the learned jurisdictional court will obviously take the same into consideration while deciding the bail application, if any, of the present petitioner. Accordingly, CRM (A) 897 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
