Mr. Gouranga Kumar Das Mr. Amal Kumar Datta ….for the State. Learned advocate appearing for the petitioners submits that petitioners have been foisted with the present criminal case as there was previous disputes. State has produced the case diary. I have taken into account the injury report and submission of the injured. Having considered the nature of the injuries, I am of the opinion that as charge sheet has already been submitted custodial detention of the present petitioners 2 are unwarranted. As such prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioners namely, (1) Saikat Mondal @ Saikat Ali Mondal @ Saheb, (2) Ali Asgar Molla be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted, this order of anticipatory bail will remain in force for a period of 6 weeks. Accordingly, CRM (A) 1103 of 2026 is allowed. Memo of Evidence submitted be kept with the record. Mr. Gouranga Kumar Das and Mr. Amal Kumar Datta learned advocate appear on behalf of the State. Their appointment be regularized by the concerned authorities. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
