JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned AGA accepts notice for respondents. 2. The petitioner is before this Court seeking for the following reliefs: a. Call for entire records; b. Issue a writ in the nature of mandamus to respondent-1 and 2, directing them to register a FIR as per Annexure-B Dated 06.09.2025, Annexure-D Dated 01.10.2025, Annexure-F Dated 15.10.2025 and Annexure-G Dated 25.01.2026. as expeditiously as possible; c. Grant such other relief, order or direction to the respondent in the circumstances of the case. 3. The grievance of the petitioner is that the complaints which have been submitted by the petitioner on 06.09.2025, 01.10.2025, 15.10.2025 and 25.01.2026 have not been considered by respondents and registered as a crime number with ensuing investigation. 4. A perusal of the papers would indicate that the initial complaint was submitted on 06.09.2025 as regards which the endorsement dated 06.09.2025 had been issued stating that the dispute is civil in nature. - 3 - HC-KAR CNR: KAHC010605922026 NC: 2026:KHC:48206 WP No. 27509 of 2026 5. Subsequently, another compliant was sought to be filed on 25.01.2026 accompanied by medical records which have been produced at Annexure-H along with photographs, which when the petitioner had sought to submit to the respondent-police was not accepted, is the submission of the learned counsel for the petitioner. 6. A perusal of the medical records issued by the Sri Chamarajendra HIMS Teaching Hospital, Hassan, Karnataka, which is a government hospital and the photographs indicate that there is assault which has allegedly occurred on the head of the complainant. In such background, it was but required for the respondent to have accepted the subsequent complaint which was on a different cause of action and gone ahead with the investigation after registering a crime number. 7. Since the earlier complaint had been rejected on the ground that they are civil disputes would not mean that the subsequent complaint where an physical assault has been alleged and medical records are produced to establish the same, the complaint could have been once again refused. In that background, this Court passes following; - 4 - HC-KAR CNR: KAHC010605922026 NC: 2026:KHC:48206 WP No. 27509 of 2026 ORDER i. The writ petition allowed. ii. A writ of mandamus is issued directing the respondents to register a complaint in terms of the petitioner's last complaint dated 25.01.2026, produced at Annexure-G, by taking into consideration the medical records subsequently produced by the petitioner.
