JUSTICE RAVI CHIRANIA Order 25/02/2026 This writ petition has been filed on behalf of the petitioner challenging the order dated 06.10.2017 passed by the learned trial Court. Brief facts of the case are that the respondent-plaintiff filed a suit before the learned trial Court for specific performance and the said suit was withdrawn by the respondents-plaintiff on the basis of compromise between the parties and the learned trial Court ordered for refund of the court fees. When the respondent-plaintiff filed an application before the petitioner-department for refund of the said amount of Rs.2,14,600/-, the department has refused to refund the said amount on the ground that the respondent- plaintiff has not submitted the original stamps in view of Rule 52 of The Rajashtan Stamps Act, 1998 and Rules 2002. The trial Court in its order has mentioned that the original file of the said suit was missing and thereafter, by the order of the Court, the file was reconstituted and considering the fact that original file was misplaced, the learned trial Court has ordered for refund of the amount of stamp duty of Rs.2,14,600/-. In our considered view, no error has been committed by the learned trial Court in passing of the order dated 06.10.2017 in the circumstances of the present case.
