2. The prosecution story, in brief, is that the police of Police Station Gandhi Nagar, District Surguja (C.G.), received secret information through an informant and, on the basis of the said information, conducted a raid and seized a total of 1,500 pieces of Rexogesic Buprenorphine Injection IP, 2 ml each, having a total quantity of 3,000 ml, from the possession of the present applicant. Thereafter, the aforesaid offence was registered against the applicant. 3. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in this case. He would further submit that the charge-sheet has been filed, the applicant has been in jail since 19.3.2026, and the conclusion of the trial is likely to take some time. Therefore, he prays for grant of bail. 4. On the other hand, learned counsel for the State opposes the bail application and would submit that a total of 1,500 injections of Rexogesic Buprenorphine Injection IP, 2 ml each, having a total quantity of 3,000 ml, were recovered from the possession of the present applicant, which is much above the commercial quantity. She would further submit that the application filed by the applicant deserves to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6.
Taking into consideration the fact that the quantity of contraband article seized, i.e., 1,500 injections of Rexogesic Buprenorphine Injection IP, 2 ml each, having a total quantity of 3,000 ml, was recovered from the possession of the present applicant and is much above the commercial quantity, coupled with the fact that the charge-sheet has been filed in
3 this case, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the first bail application filed by the applicant is hereby rejected. Sd/-
