ORAL JUDGMENT
Heard Sri G.L.Vishwanath, learned Senior Advocate along with Sri Mahesh M, learned counsel for the appellants, and Sri K.N.Aravinda Navada, learned counsel for caveator/respondent Nos.1 to 4.
2. Parties present. Matter was adjourned on 28.08.2026, noting the fact that there was no amicable settlement though there was an earnest attempt by the parties to the appeal. Therefore, this Court admitted the appeal and thereafter posted the matter for hearing.
3. Soon thereafter, on 29.08.2026 both the parties mentioned the matter to the Court that after the order dated 28.08.2026 parties have again rethought over the issue involved in the appeal and they have realised that amicable settlement is the most appropriate way to put an end to the litigation matter and accordingly they requested the Court to list the matter to today to report settlement.

4. Memo filed by the parties in this regard was accepted and matter was ordered to be listed to today.
5. Today, parties appear before the Court and they present a compromise petition under Order XXIII Rule 3 of the Code of Civil Procedure signed by the parties and their respective advocates.
6. Pursuant to the compromise terms, demand draft in a sum of ₹14,00,000/- in the name of each of the respondents drawn on Karnataka Bank is handed over. Same is acknowledged by the respondents by signing the order sheet.
7. Parties on enquiry would also admit that there is no force, undue influence or coercion in reaching out the terms of the settlement.
8. Taking note of the above factual aspects, there is no impediment for this Court to accept the compromise petition and dispose of the appeal in terms of the compromise petition.

ORDER i. Appeal stands
disposed of in terms of compromise petition. ii. Office is directed to pass modified decree appending the copy of the compromise petition as part of the decree.
