1. The instant application has been filed under Sections 483 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail in connection with Keredari P.S. Case No. 136 of 2025 registered under Section 190, 191(3), 126(1), 115(2), 109, 329(3), 303(2), 351(2), 352 of B.N.S. pending in the court of learned Judicial Magistrate 1st Class, Hazaribag. 2. It has been contended on behalf of the petitioner that the petitioner is innocent and has falsely been implicated in this case. 3. It has been contended that the petitioner although is named in the FIR but he was not arrested on the spot as also there is no specific allegation of any overt act against the petitioner. 4. It has also been contended that there is no recovery of any incriminating material from the possession of the petitioner. 5. It has also been contended that the alleged occurrence has been recorded in CCTV footage and during investigation the pendrive was handed over to the investigating officer from which it is clear that the petitioner was nowhere seen entering inside the campus of the mining project, as such, the case is not supported by any cogent material. It has also been contended on behalf of the petitioner that the co- accused persons, namely, Jay Narayan Mahto @ Jay Narayan Kumar and Abhishek Kumar @ Abhishek Rana have also been granted bail by the co-ordinate Bench of this Court vide order dated 01.12.2025 passed in B.A. No. 9922 of 2025 which has been appended as Annexure-2 to the instant application. 7. The ground of custody has also been taken since the petitioner is languishing in judicial custody since 08.01.2026. 8. Learned counsel for the petitioner, therefore, on the aforesaid grounds, has prayed that the present petitioner may be released on bail. 9.
Learned Public Prosecutor appearing for the opposite party-State although has seriously opposed the prayer for grant of bail but he has not disputed the fact of grant of bail in favour of the co-accused persons, namely, Jay Narayan Mahto @ Jay Narayan Kumar and Abhishek Kumar @ Abhishek Rana. 10. This Court has heard the learned counsel for the parties. 11. This Court has perused the order dated 01.12.2025 passed by the co- ordinate Bench of this Court in B.A. No. 9922 of 2025 which has been appended as Annexure-2 to the application wherefrom it appears that the co-accused persons, namely, Jay Narayan Mahto @ Jay Narayan Kumar and Abhishek Kumar @ Abhishek Rana have also been granted bail by the co-ordinate Bench of this Court vide order dated 01.12.2025 passed in B.A. No. 9922 of 2025 and the said fact has not been disputed by the learned Public Prosecutor appearing for the opposite party, as such, considering the aforesaid fact, this Court is of the view that the present application deserves to be allowed. 12. Accordingly, the instant bail application stands allowed. 13. In consequence thereof, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Hazaribagh in connection

with Keredari P.S. Case No. 136 of 2025 with the condition that the petitioner shall co-operate in the trial and shall not absent himself on the date fixed without any cogent cause.
