Respondent(s) For Applicant/s : Ms. Kiran Jain, Advocate For Non-Applicant : Ms. Ankita Shukla, P.L. Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 07/10/2026 1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for grant of temporary bail to the applicant in connection with the Crime No.68/2026, registered at Police Station Komakhan, District Mahasamund for the offences punishable under Sections 20(b)(II)(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, NDPS Act). NIRMALA RAO 2 2. The case of the prosecution, in brief, is that the police of Police Station Komakhan, District Mahasamund, received secret information, conducted a raid, and seized 77 kilograms of Ganja from the possession of the applicant and other co-accused persons. Thereafter, the aforesaid offence was registered against the applicant. 3. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in the case. She further submits that the applicant has been in jail since 9.5.2026, the charge- sheet has been filed, and there are no criminal antecedents against the applicant. Thus, she prays that the applicant may be enlarged on temporary bail. 4. On the other hand, learned State counsel opposes the bail application and submits that 77 kilograms of Ganja was seized from the possession of the applicant and other co-accused persons, which falls within the definition of commercial quantity. She would submit that the application filed by the applicant deserves to be dismissed. 5. Heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the fact that the applicant is being provided medical treatment at Government Medical College, Raipur, and that the documents in this regard have been placed on record by learned counsel for the State, it is evident that the applicant was admitted to the hospital on 19.5.2026 and was discharged on 2.8.2026. The applicant filed the present temporary bail application on 22.8.2026; however, this fact was not disclosed in the application. 3 7. Having considered the fact that the applicant has already been provided medical treatment, I am not inclined to grant temporary bail to the applicant. 8. Accordingly, the temporary bail application filed by the applicant is hereby rejected. Sd/- Rakesh Mohan Pandey JUDGE Nimmi
