03.09.2026 Item No.22 Ct. No. 19 RP W.P.A. 15219 of 2026 CALCUTTA REALITY PVT. LIMITED & ANR. Vs STATE OF WEST BENGAL & Ors. Mr. Amiya Kumar Gayen ….. For the Petitioner Mr. Shiv Shankar Banerjee Mr. Ajit Kumar Mishra Mr. Adhip Banerjee …..For State 1. This Court has heard the learned advocate for the petitioners and the State. 2. By filing the instant writ petition the writ petitioner has prayed for issuance of appropriate writ or writs against the respondent authorities, more specifically against the respondent no.6 authority, to demarcate and identify the unacquired plot of land, particulars of which has been annexed as Annexure P1. 3. On perusal of page 58 of the instant writ petition it reveals that in an earlier round of litigation, being WPA 5358 of 2025 this Court while disposing the said writ petition by its order dated 22.05.2025 noticed that a similar prayer has been made by the writ petitioners for demarcation of their unacquired land and thus disposed of the said writ petition by granting liberty to the writ petitioners to approach the Land Reforms and Tenancy Tribunal. 2 4. At the time of hearing, Mr. Banerjee, learned advocate appearing for the State draws attention of this Court to page no.75 of the instant writ petition, being a copy of the order dated 21.07.2025 as passed by the WBLRTT in OA No.1678 of 2025. It is submitted that the WBLRTT is already in seisin over the selfsame subject matter. 5. Mr. Gayen, learned advocate for the petitioner strongly disputed such contention. 6. On careful perusal of the entire materials as placed before this Court it appears that the prayers made in the instant writ petition are identical with the prayers made in WPA 5358 of 2025, which has already been disposed of by this Court by its order dated 22.05.2025. In view of such, this Court finds that the present writ petition is hopelessly barred by the principles of res judicata. 7. With the aforementioned observations, this instant writ petition is dismissed. (PARTHA SARATHI SEN, J.)
