Heard learned counsel for the parties. 2. Mr. Indrajit Sinha, the learned counsel for the petitioner states that the petitioner has made a representation dated 27th December, 2025 for seeking refund of the forfeited earnest money. He submits that for the present, the petitioner would be 2026:JHHC:8495-DB 2 satisfied if some directions are issued to the 5th respondent for disposal of this representation in accordance with law and on its own merits. 3. Mr. Piyush Chitresh, learned AC to AG states that the 5th respondent will dispose of the petitioner’s representation in accordance with law and on its own merits within eight weeks from today. 4. By accepting Mr. Piyush Chitresh’s statement and directing the 5th respondent to act accordingly, we dispose of this petition. The 5th respondent must hear the petitioner and dispose of the representation by passing a reasoned order. 5. We, however, clarify that we have not examined the merits or demerits of the matter and, therefore, all contentions of all parties are left open to be decided by the 5th respondent in the first instance. 6.
