1 CGHC010382702026 2026:CGHC:42991 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 9221 of 2026 Amit Korram S/o Kanwal Korram, Aged About 35 Years R/o Village Kaneri Maneripara, Tehsil Purur District Balod C.G. ---(Correct Details And Address Mentioned). ... Applicant versus State Of Chhattisgarh Through P.S. Purur District Balod C.G. ... Non-Applicant For Applicant : Shri Shobhit Koshta, Advocate. For Non-Applicant/State : Ms. Ankita Shukla, Panel Lawyer. (HON’BLE SHRI JUSTICE RAKESH MOHAN PANDEY) Order on Board 05/10/2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 61/2026 registered at Police Station Purur, District Balod (C.G.), for the offence punishable under Sections 20 (b) (ii) (B) read with Section 8 of the Narcotic Drugs and Psychotropic Substances Act (for short, the NDPS Act) against the present applicant. 2. The case of the prosecution, in brief, is that on 28.05.2026, the Police on the basis of secret information, intercepted the applicant and co- accused Ravi Netam and their motorcycle bearing registration No.CG- Digitally signed by ALLENA ANJANI KUMAR Date: 2026.10.06 10:37:33 +0530 2 24-K-0170 and after search, seized 12.200 kilograms of contraband ganja, which was being transported by the present applicant. Thereafter, the police completed investigation in accordance with the provisions of NDPS Act and registered offence against the applicant, as stated above. 3. Learned Counsel for the applicant would submit that the alleged contraband article i.e., ganja was seized from the possession of co- accused Ravi Netam; the applicant has only one live criminal antecedent registered for commission of offence under the provisions of BNS; name of the applicant has surfaced on the basis of memorandum statement of co-accused; charge-sheet has already been filed; the applicant is in jail since 14.07.2026 and further, conclusion of the trial is likely to take some considerable time. Therefore, he would pray that the application may be allowed and she may be enlarged on bail. 4. On the other hand, learned counsel for the State would oppose the bail application and argue that the applicant and other co-accused person were transporting the contraband ganja illegally on a motorcycle. It is also submitted that the police searched and seized total ganja weighing 12.200 kilograms from the possession of the present applicant and co-accused, therefore, the present applicant is not entitled for grant of regular bail in the present case. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the fact that the alleged contraband ganja was 3 seized from the possession of co-accused Ravi Netam; the applicant has only one live criminal antecedent registered for commission of offence under the provisions of BNS; name of the applicant has surfaced on the basis of memorandum statement of co-accused; charge-sheet has already been filed; the applicant is in jail since 14.07.2026 and further, conclusion of the trial is likely to take some considerable time, I am inclined to grant bail to the applicant. Accordingly, the instant bail application is allowed. 7. It is directed that the applicant shall be released on bail on his furnishing a personal bond in sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. 8. 8. The observation made herein above is for the purpose of deciding this bail application only and the trial Court shall decide the case on its own merits. Sd/- (Rakesh Mohan Pandey) JUDGE Anjani
