Affidavit of service filed on behalf of petitioner is taken on record. 2. By presenting this writ petition, inter alia, praying for direction upon concerned police authorities which would permit the petitioner to carry out construction work on the land of the petitioner. It is submitted that private respondents are disturbing peaceful possession of the petitioner and restraining petitioner from carrying out construction requiring intervention by the concerned police authorities to facilitate construction work. 2 3. Learned advocate representing private respondents have disputed submissions made on behalf of petitioner and it is further submitted that Title Suit No. 389 of 2026 for partition is pending before the learned Civil Judge (Senior Division) 1st Court, Berhampore, Murshidabad. It is also submitted that private respondents have instituted the suit and an ad interim order of injunction was passed directing parties to the suit to maintain status quo. Petitioner is defendant to that suit. 4. State respondents are represented by learned advocate. 5. Having considered respective submissions made on behalf of the parties it appears that issue involved in this writ petition requires consideration by the Civil Court, if approach is made by the petitioner, since it is alleged that during pendency of the suit petitioner is being illegally restrained from carrying out construction work. 6. Concerned State respondents are directed to maintain peace and tranquility at the locale and to see that no untoward incident takes place. 7.
