1. These are the first bail applications filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 81/2026 registered at Police Station Jhagrakhand, District : Manendragarh-Chirmiri-Bharatpur (C.G.), for the offence punishable under Sections 109, 115(2), 191(2), 191(3), 296 and 351(2) of BNS, 2023.
2. Case of the prosecution is that on 18.07.2026, the applicant along with co-accused persons armed with axes and lathis confronted the complainant party over the cultivation of disputed agricultural land. In the ensuing altercation, the accused persons assaulted the complainant’s husband, Krishna Kumar Sahu, and son, Aman Kumar, inflicting axe and blunt injuries on their heads and vital parts. On the basis of the written report, police registered offence as stated above and arrested the applicants.
3.
Learned counsel for the applicants submits that there is an ongoing land dispute between the parties and a scuffle ensued when the complainant party made an illegal attempt to cultivate the disputed land. He further submits that a counter-FIR was also lodged against the complainant party, and there is no medical report on record to establish that the injuries sustained by the injured persons were fatal in nature. He contends that applicant
3 Sitasharan has no criminal antecedents, whereas applicant Akhilesh has one criminal antecedent of preventive detention. He further contends that the charge-sheet has already been filed, the applicants have been languishing in jail since 18.07.2026, and conclusion of the trial is likely to take a long time, therefore, he prays for the grant of regular bail to the applicants. 4. On the other hand, learned counsel for the State opposes the bail application and submits that the injuries sustained by Krishna Kumar Sahu were serious in nature and applicant Akhilesh has one criminal antecedent, therefore, the applicants are not entitled to the grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. It appears that there was a land dispute between the parties, and an FIR as well as a counter-FIR were lodged by the parties. There is no document on record to establish that the injured persons suffered any life-threatening injuries. Furthermore, co- accused Bindu has already been granted anticipatory bail by the coordinate Bench in MCRCA No. 1275 of 2026. 7. Taking into consideration the aforesaid discussion coupled with the fact that the charge-sheet has been filed before the competent Court and applicants are in jail since 18.07.2026, conclusion of the trial may take some more time, this Court is of
4 the view that the applicants are entitled to be released on bail in this case. 8. It is directed that in the event of the applicants executing a personal bond for a sum of Rs.
50,000/- to the satisfaction of the concerned trial Court, they shall be released on bail on the following conditions:- (a) they shall make themselves available for interrogation by the police officer as and when required; (b)they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; and (c) they shall not act in any manner which will be prejudicial to a fair and expeditious trial. The observation made hereinabove is for the purpose of deciding this bail application only, the learned trial Court shall decide the case on its own merits. -
