During the pendancy of the present writ petition, the Adjudicating Authority passed an order on 23.12.2025 confirming the provisional attachment order. The petitioner has filed an application seeking to challenge the said order by amending the writ petition. 3. Today, when the matter is taken up for consideration, learned counsel for the petitioner files a memo seeking permission of this Court to withdraw the writ petition, with liberty to challenge the provisional attachment order, so also, the confirmatory order before the Appellate Tribunal in terms of Section 26 of Prevention of Money Laundering Act, 2002. 4. It is noticed that there is a limitation of 45 days to challenge the confirmatory order before the Appellate Tribunal. The petitioner is before this Court since 12.11.2025 and the - 4 - HC-KAR CNR: KAHC010742492025 NC: 2026:KHC:48155 WP No. 34934 of 2025 confirmatory order has been passed during the pendency of the present petition. The time spent by the petitioner before this Court shall be excluded from reckoning of the limitation, if an appeal is filed by the petitioner, within three weeks from the date of receipt of certified copy of this order.
