VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 23.09.2025 passed by the - 3 - HC-KAR NC: 2026:KHC:21878-DB CCC No. 291 of 2026 learned Single Judge of this Court in Arbitration Petition - Interim Measure No.4/2025. In terms of the said order, the accused was directed to deposit an amount of `5,90,00,000/- [Five Crore Ninety Lakh only] with the Court within a period of ten days from today. The Registry was directed to keep the amount in an interest earning fixed deposit for a period of one year. 2. The learned counsel for the accused has filed a compliance affidavit affirming that an amount of `5,90,00,000/- [Five Crore Ninety Lakh only] has been deposited in due compliance with the orders passed by the Court. The photocopies of the demand drafts have also been annexed. 3. The learned counsel appearing for the complainant states that although the amount has been paid, the affidavit of compliance indicates that payments have been made by the counsel of the accused and not by the accused. He submits that this could not be considered as a compliance by the accused. 4. The learned counsel appearing for the accused submits that the family of the accused is in financial distress and therefore, funds have been arranged. She fairly states that any apprehension - 4 - HC-KAR NC: 2026:KHC:21878-DB CCC No. 291 of 2026 that the complainant may have with regard to any separate claim being made on account of the same being deposited by a third party, is unfounded. She states that the amount should be considered as paid by the accused for all intents and purposes. 5. We also note that the affidavit filed by the counsel unequivocally affirms that the payments are made in compliance with the orders passed by the Court. Since it is clarified by the learned counsel that the amounts deposited are required to be considered as amounts deposited by the accused, the apprehension expressed by the learned counsel is addressed. 6.
