JUSTICE LALITHA KANNEGANTI ORAL ORDER Aggrieved by the order passed in I.A.No.3 in COM.OS.No.02/2023 dated 11.05.2023 by the Principal District and Sessions Judge, Ramanagara, whereby the trial Court had dispensed with Section 12A of the Commercial Courts Act, 2015, the plaintiff is before this Court. 2.When the matter came up for hearing, learned counsel for the petitioner submits that he may be permitted to withdraw the writ petition with a liberty to file an appropriate petition under Order VII Rule 11 of CPC before the Commercial - 3 - HC-KAR CNR: KAHC010566992026 NC: 2026:KHC:47600 WP No. 25725 of 2026 Court. Considering the same, this Court is passing the following: ORDER i. The writ petition is disposed of, giving liberty to the petitioner to file an appropriate application under Order VII Rule 11 of CPC and the court shall consider the same in accordance with law. ii. In the light of the settled law, this order will not come in the way of the petitioner in filing an application under Order VII Rule 11 of CPC iii. Pending I.As in the petition shall stand closed.
