The affidavit of service filed today is taken on record. 2. Leave as sought for to correct paragraph 6 of the writ petition is granted. Let such correction be made. 3. The petitioner retired from service of the Durgapur Projects Limited on 31st August, 2024. His allegation is that his terminal dues, including gratuity and leave encashment, have not been disbursed in his favour despite the same being sanctioned. 4. Prayer has been made to direct the respondents to release the terminal dues along with interest on account of delayed payment. 5. Upon hearing the submissions made on behalf of both the parties and on perusal of the documents annexed to the writ petition, it appears that the 2 petitioner, though retired in the year 2024 but has not received terminal dues till date. The dues were sanctioned on 1st August, 2026. 6. The terminal dues of an employee are his legal entitlement. Such payments ought to have been made immediately upon his retirement. 7. In view of the above, the respondent nos.2 and 4 are directed to take prompt necessary steps to disburse the gratuity and leave salary in favour of the petitioner positively within a period of eight weeks from the date of communication of this order. 8. As the petitioner will receive his legal terminal dues after some delay, the gratuity and leave encashment shall be paid along with simple interest calculated at the rate of six percent per annum payable on and from the next date of retirement till the date of actual payment. 9. The writ petition stands disposed of. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
