In this petition, the petitioner is assailing the order dated 10.06.2026 (Annexure-A) in Revision Petition No.123/2026 on the file of the Karnataka Appellate Tribunal at Bengaluru; order dated 16.12.2025 at Annexure-B passed by respondent No.1 and order dated 19.09.2023 (Annexure-C) passed by Respondent No.2. 3. Having heard the learned counsel appearing for the parties, the petitioner is claiming right over the property - 4 - HC-KAR CNR: KAHC010581302026 NC: 2026:KHC:46168 WP No. 26505 of 2026 as an unauthorized occupant. In this regard, this Court in W.P.No.17450/2017 (MANJUNATHA B v/s THE STATE OF KARNATAKA AND ANOTHER) disposed of on 23.01.2018 (Annexure-G) at paragraph 4 has held as follows: “4. After hearing the learned counsel for the petitioner as well as learned Additional Government Advocate, this Court would observe that the proceedings which was said to be raised by petitioner is to protect his possession of land, which is sought to be regularized against rival applicants has resulted in a decree being passed in his favour in a suit for permanent injunction in OS No.954/1992, disposed of by judgment dated 8.1.1997. It is also submitted by the learned counsel for petitioner that there was one more round of litigation in OS No.211/2007 and said suit is also decreed in favour of petitioner by judgment dated 1.4.2017. In that view of the matter, it is made clear that when the aforesaid two judgments are placed before the competent authority as and by way of additional evidence, the authority shall consider the application/representation of the petitioner which is at Annexure-F dated 4.3.2017, - 5 - HC-KAR CNR: KAHC010581302026 NC: 2026:KHC:46168 WP No. 26505 of 2026 in accordance with law and issue saguvali chit, if said documents establish petitioner’s possession and cultivation.” 4. Following the declaration made by this Court, respondents No.1 and 2 passed the impugned orders at Annexures-B and C wherein, the said orders has been confirmed by the Karnataka Appellate Tribunal in Revision Petition No.123/2026 at Annexure-A and a finding has been recorded by both the authorities that Saguvali Chit issued in favour of the petitioner has been made without following the observations made by this Court. 5. In that view of the matter, as the matter has been remanded to the authorities by this Court to reconsider the issue afresh, in accordance with the provisions contained under the Karnataka Land Revenue Act, 1964 read with Rules made thereunder, the writ petition is allowed. The matter is remitted to respondent No.2 to reconsider the issue afresh and take a decision in the matter in terms of - 6 - HC-KAR CNR: KAHC010581302026 NC: 2026:KHC:46168 WP No. 26505 of 2026 the observations made by this Court in W.P.No.17450/2017 disposed of on 23.01.2018 (Annexure-G) at the earliest.
