JUSTICE M.NAGAPRASANNA - 3 - HC-KAR CNR: KAHC010521142026 NC: 2026:KHC:47533 CRL.P No. 11534 of 2026 ORAL ORDER The petitioners - accused Nos.1 to 3 are before this Court calling in question the proceedings in C.C.No.21890/2026 registered for offences punishable under Sections 120(B), 182, 409, 419, 464, 465, 468, 471, 201, 204 read with Section 34 of the IPC and under Sections 66C, 84C of the Information Technology Act, 2000. 2. Heard Sri. C.S. Pradeep, learned counsel appearing for the petitioners, Sri. B.N. Jagadeesha, learned SPP appearing for the respondent and have perused the material on record. 3. Learned counsel appearing for the petitioners would submit that except the statements, there is no overt act by the petitioners nor has indulged in any act of burning of the voters list as alleged. The burning of papers undoubtedly has taken place of old papers for setting the premises for festivities. 4. Learned SPP however has produced a chart. In that light, the learned counsel for the petitioners would now submit that he would avail the remedy of filing the discharge and in the event the discharge application would go against the petitioners, seek reservation of liberty to approach this Court all over again, keeping all the contentions open. 6. Therefore, the contentions would remain open and the petitioners are at liberty to avail the remedy of discharge. In the event the discharge application is not considered favourably at the hands of the concerned Court, the petitioners are at liberty to knock at the doors of this Court. Ordered accordingly.
