Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with 2(c)CC Case No.14 of 2025 pending in the file of learned S.D.J.M., Berhampur arising out of Berhampur R.P.F Post Case No.C3C-1433 of 2025 on the grounds stated. 3. Perused the PR as at Annexure-1. Recorded the submission of Mr. Chand, learned counsel for the petitioner and also Mr. Nayak, learned counsel for the Railway. It is submitted that the petitioner does not have any similar antecedent. The allegation is about booking of reservation tickets and suspected involvement of the petitioner in such booking. It is informed to the Court that the final PR is not yet filed. Considering the allegation in the FIR and a case registered under Section 143 of the Railways Act alleging that p. 2 the petitioner was involved in illegal booking of reservation tickets but claiming to have no other similar antecedents, this Court though not in favour of considering his plea for pre-arrest bail but directs that he should instead be directed to surrender before the learned court below for being released with conditions and upon verification as to absence of any other antecedent of similar nature. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned S.D.J.M., Berhampur within fortnight from today, it is directed that he shall be released on bail in connection with Berhampur R.P.F Post Case No. C3C- 1433 of 2025 corresponding to 2(c)CC Case No.14 of 2025 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper and in the facts and circumstances of the case besides the following, such as, he shall cooperate the I.O in the investigation without default. Furthermore, the above order shall be given effect to only if the petitioner is having no other similar antecedent. 6. Issue urgent certified copy of this order as per rules and in course of the day.
