Ms. Aparajita Mitra …for the State. 1. Supplementary affidavit filed on behalf of the petitioners is taken on record. 2. By the present writ petition, the petitioners seek for mutual transfer within the District of Bankura. 3. The petitioners contend that the petitioner no.1, Abhijit Das, joined as an Assistant Teacher in Guniada Boys’ Primary School, District Bankura on 23rd December, 2003 and confirmed in service with effect from 23rd December, 2005. Presently, petitioner no.1 is serving as a Head Teacher in Papra Primary School. The petitioner no.2, Debdulal Mallick, joined as an Assistant Teacher in Susunia Nadupara Primary School, District Bankura on 1st April, 2000 and is confirmed in service with effect from 1st April,
2002. Presently, petitioner No.2 is serving as Head Teacher in Khatra Musalmanpara Primary School. 2
4. Both the petitioners jointly made representation for mutual transfer on 18th February, 2026 before the District Primary School Council, Bankura, respondent no.4. However, the same is still pending consideration. Hence, this writ petition. 5. Mr. Malay Bhattacharyya, learned Advocate appearing on behalf of the petitioners submits that the matter be relegated to the appropriate authority for consideration of the application of the petitioners for mutual transfer. 6. Learned Advocates for the State submits that the Utsashree portal is presently functional and the petitioners should file such application seeking transfer through Utsashree portal under the existing rules. 7. To this, Mr. Bhattacharyya, learned advocate appearing for the petitioners submits that the Utsashree portal is not functional as yet. 8. In view of the above, liberty is granted to the petitioners to file application through Utsashree portal seeking mutual transfer. In the event, the petitioners are unable to submit such application through Utsashree portal, the respondent no.4, the District Primary School Council, Bankura is directed to consider the representation of the petitioners dated 18th February, 2026 for mutual transfer and dispose of the same, upon giving notice to the petitioners, by passing a reasoned order in accordance with law,
3 within a period of eight weeks from the date of communication of this order. 9.
The reasoned order is to be communicated to the petitioners within one week from the date of passing of such order. 10. Learned advocate for the petitioners is directed to communicate this order to the respondent no.4, the District Primary School Council, Bankura. 11. With the above direction, the writ petition being WPA 5281 of 2026 stands disposed of. 12. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 13. Interim order, if any, stands vacated. 14. All connected applications, if any, stand disposed of. 15. There shall be no order as to costs. 16. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 17. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
