JUSTICE CHILLAKUR SUMALATHA - 3 - HC-KAR NC: 2026:KHC:11299 WP No. 6060 of 2026 ORAL ORDER Heard Sri.Veerabhadraiah.M learned counsel for the petitioner. 2. This writ petition is filed seeking the Court to direct the Court of III Additional Principal Judge, Family Court, Bengaluru to dispose of M.C No.3005/2022 pending on its file time bound. 3. In the light of the limited relief sought for, this Court is of the view that service of notice to respondent is not required and hence notice to respondent is dispensed with. 4. Learned counsel for the petitioner submits that petitioner is the husband of respondent. Petitioner filed a petition on 25.05.2022 invoking Section 13(1) (ia) of Hindu Marriage Act seeking a decree of divorce. Respondent/wife entered into appearance. However, respondent/wife is dragging on the proceedings by taking time continuously. Since four years petitioner is attending the Court regularly but he could not get justice. Learned counsel thereby seeks to give a direction to the Family Court to dispose of the matter time bound. - 4 - HC-KAR NC: 2026:KHC:11299 WP No. 6060 of 2026 5. The certified copy of the proceeding sheet reveals that respondent took lot of time to cross examine PW-1. Further cross examination of PW-1 was therefore closed on 21.06.2025. The matter was posted for respondent's evidence and after taking sufficient time, respondent filed I.A Nos.VI and VII seeking to recall PW-1 for cross-examination. Those applications were allowed. Again sufficient time was granted to further cross examine PW-1. 6. Admittedly, the case was filed in the year 2022 and till now the proceedings have not attained finality. Therefore, this Court is of the view that direction as sought for is required to be issued. Therefore, the writ petition is disposed of with the following:- ORDER i. The Court of III Additional Principal Judge, Family Court, Bangalore is directed to dispose of M.C. No.3005/2022 pending on its file as expeditiously as possible preferably within a period of three months from the date of receipt of copy of this order. - 5 - HC-KAR NC: 2026:KHC:11299 WP No. 6060 of 2026 ii. As the writ petition is disposed of without service of notice to respondent, Family Court is directed to serve copy of this order to the respondent so as to give notice to the respondent about filing of this writ petition by the petitioner and its disposal. iii.
