Page No.# 3/4 BEFORE HONOURABLE MR. JUSTICE KARDAK ETE ORDER Date : 06-02-2026 Heard Mr. S. Roy, learned counsel for the applicant/claimants. 2. This is an application seeking clarification/correction of the order dated 13.12.2025 passed in MAC Appeal No. 470/2025 in the National Lok Adalat. 3. It is noticed that by the order dated 13.12.2025, passed in MAC Appeal No. 470/2025 in the National Lok Adalat, this Court had directed the Insurance Company to deposit the remaining amount of Rs. 6,36,000/- (Rupees Six Lakhs Thirty-Six Thousand) only, in view of the settlement for an amount of Rs. 20,00,000/- (Rupees Twenty Lakhs) only as the full and final settlement of the claim, out of which Rs. 13,64,000/- (Rupees Thirteen Lakhs Sixty-Four Thousand) only had already been paid. Accordingly, the Court directed that Claimant No. 1 would be entitled to Rs. 3,81,600/- (Rupees Three Lakhs Eighty-One Thousand Six Hundred) only, and Claimant No. 2 would be entitled to Rs. 2,54,400/- (Rupees Two Lakhs Fifty-Four Thousand Four Hundred) only out of the Rs. 6,36,000/- (Rupees Six Lakhs Thirty-Six Thousand) only.
However, the said amount of Rs. 13,64,000/- (Rupees Thirteen Lakhs Sixty-Four Thousand) only has already been deposited before the Registry of this Court and it appears that inadvertently, the order recorded the amount as “paid” instead of
“deposited before the Registry”. 4. In view of the above, it is directed that the amount of Rs. Page No.# 4/4 13,64,000/- (Rupees Thirteen Lakhs Sixty-Four Thousand) only, which has already been deposited before the Registry of this Court, along with the balance amount of Rs. 6,36,000/- (Rupees Six Lakhs Thirty-Six Thousand) only, which has been directed to be deposited by the Oriental Insurance Company Ltd. before the Registry of this Court, shall be allowed to be withdrawn by the claimants. 5. It is submitted by Mr. S. Roy, learned counsel for the applicant/claimants, that the claimants have mutually agreed to apportion the settlement amount of Rs. 20,00,000/- (Rupees Twenty Lakhs) between them at 60:40 ratio. 6. Accordingly, claimant No. 1, namely Habija Begum, shall be entitled to 60% of the total settlement, amounting to Rs. 12,00,000/- (Rupees twelve lakhs) and claimant No. 2, namely Husna Begum @ Husnara Begum, shall be entitled to 40% of the total settlement, amounting to Rs. 8,00,000/- (Rupees eight lakhs). The claimants are permitted to withdraw their respective shares from the Registry upon proper verification and identification. 7. This interlocutory application stands allowed and disposed of. 8. This order shall be read as part of the order dated 13.12.2025, passed in MAC Appeal No. 470/2025 in the National Lok Adalat. JUDGE Comparing Assistant
