The instant Criminal Petition is filed under Section 482 of BNSS, by the Petitioner / Accused seeking anticipatory bail in connection with Crime No.52 of 2026 on the file of Lalapet Police Station, Guntur for the offences under Sections 420, 406 and 506 of IPC. 2. Sri T.Ravi Teja, learned counsel for the Petitioner would submit that the alleged transaction is relating to the year 2020 and the crime has been registered on 09.03.2026 by influencing the Police. Learned counsel would
2 further submit that, even as per the contents of the complaint, the Petitioner took Rs.25.00 lakhs from the De facto complainant by way of investment and failed to return the amount. In fact it is a civil dispute, but the Police want to interfere under the influence of the De facto complainant. 3. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders directing the Police to follow the procedure contemplated under Section 35(3) of BNSS since the offences alleged against the Petitioner are punishable with less than seven years period of imprisonment. 3. Considering the submissions, this Criminal Petition is disposed of with the following; a. Investigating Officer is at liberty to complete the investigation, in accordance with law. b. In the event of any coercive action sought to be taken against the Petitioners, concerned Police Authorities are directed to scrupulously follow the procedure prescribed under Section 35(3) of BNSS and the guidelines laid down by the Hon’ble Supreme Court in Arnesh Kumar v. State of Bihar1, which is reiterated in in Satender Kumar Antil vs. CBI and another2.
