1. This misc. bail application has been filed by the petitioner Vijay Singh@ Damo S/o Shri Ratanlal, who was arrested by the police in connection with the FIR bearing No.125/2024 dated 03.04.2024 registered at Police Station Bayana, District Bharatpur for the offences punishable under Sections 420 and 406 of IPC.

Learned counsel submits that he has not committed any offence rather he provided facility to the complainant in preparation of Visa for going abroad and also introduced him to the other persons in this regard. He further submits that the allegations as leveled against the petitioner are triable by Magistrate and no recovery is required to be made. The police has completed the investigation and the trial will take a sufficient long
[2026:RJ-JP:11059] (2 of 3) [CRLMB-3610/2026] time, in view thereof, learned counsel prays that the petitioner may be enlarged on bail by this Court.
3. Learned Public Prosecutor strongly opposed the bail application.

This Court noted that the petitioner has not committed similar offences with other persons, a querry was also raised in this regard by the Court, learned Public Prosecutor failed to inform this Court as to whether any other persons have made any complaint against the petitioner with the allegations of similar nature.
5. Be that as it may.
6. This Court after considering overall facts and circumstances of the case and noticing that the case is triable by Magistrate without commenting on the merits of the case is inclined to enlarge the petitioner on bail by allowing the present bail application.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Vijay Singh@ Damo S/o Shri Ratanlal shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.

8. It is directed that if the petitioner herein is found to be involved in any offence of similar nature within a period of two years of passing of this order, learned Public Prosecutor shall file an application for cancellation of this bail, without any fail.
