This is the first bail application filed u/s 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.748/2025 registered at Police Station Kotwali, Rajnandgaon, District- Rajnandgaon (CG) for offence punishable under Sections 103(1), 3(5) & 238 of BNS. It is alleged that deceased Monika Ramteke’s husband Ravi Ramteke and Karan Dongre strangulated the deceased to death with a rope and the applicant was also involved in the said act. On report being lodged in this regard, the applicant was arrested on 07.12.2025. 3. Learned counsel for applicant submits that the applicant is innocent and has been falsely implicated in the case. He submits that there are total 3 accused persons. There is no specific charge against the applicant for causing the death of the deceased. The only allegation against her is that she stood at the gate to keep watch. Learned counsel further emphasizes that there is no direct evidence linking the applicant to the crime; she has been arrayed as an accused solely on the basis of circumstantial evidence. Furthermore, no incriminating articles have been seized from her possession. He further submits that there are total 27 witnesses, the trial has not yet commenced, the applicant is in jail since 07.12.2025 and there is no likelihood of the trial to be concluded at the earliest. Hence, considering all these facts, the applicant may be released on bail. 4. Learned State counsel, on the other hand, opposing the bail application submits that as per the postmortem report, the death is unnatural and homicidal in nature. He submits that acting with a common intention, the in-laws committed murder of the deceased by throttling and the applicant played a specific role in the 3 concealment of evidence. Hence, considering the nature of offence, the applicant does not deserve to be released on bail. 5. Heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the entire facts and circumstances of the case, particularly the facts that the prosecution case is based on circumstantial evidence, no seizure has been made from the applicant, there are total 27 witnesses, the trial has not yet commenced, the applicant has been in custody since 07.12.2025 and there is all possibility of the trial taking considerable time for its conclusion, this Court is of the opinion that a case for grant of bail to the applicant has been made out. 7. Accordingly, the application for grant of bail is allowed. It is directed that the present Applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. The applicant is directed to appear before the trial Court on each and every date to be given to her by the said Court till completion of the trial. 8.
