Mr. Atanu Basu, Advocate
… for the State
1. None appears for the writ petitioner. 2. State is represented. 3. Father of the writ petitioner continues to remain missing since June 16, 2023. 4. Written complaint of the petitioner was registered as a First Information Report being Beldanga PS Case No.479 of 2023 dated June 25, 2023 under Sections 365/368 of the Indian Penal Code, 1860. 5. 9. Since investigations with regard to the police case are pending, we refrain tabulating the steps taken by the police in trying to locate the missing person. 10. We find that, police took appropriate steps in order to locate the missing person. Police sent various letters to various authorities seeking information about the missing person. Missing person’s information was telecasted through the television on ‘Doordarshan’ and broadcasted on ‘Radio’. Missing person’s information was published in three different newspapers on three different languages. Polygraph test was conducted on some accused persons. The information relating to the missing person was circulated to all States and Union Territories of India for wide circulation. All Police Stations in the State of West Bengal were informed as to the details of the missing person so also the Chief Medical Officers of Health (CMOH) of all Health Districts in the State of West Bengal were also informed to check their records. Mental hospitals in the State of West Bengal were also approached. Despite such efforts, the missing person continues to remain missing. 11.
We are not minded to pass any further orders in this writ petition since the writ petitioner is unrepresented and since, we are satisfied that the
3 police took appropriate steps for the purpose of locating the missing person. 12. We, however, clarify that this order of ours will not preclude or affect the continuing investigations with regard to the police complaint. 13. Police, no doubt, will conclude the investigations with regard to the First Information Report and submit appropriate report before the jurisdictional Court. 14. WPA (H) 84 of 2023 is disposed of.
