JUSTICE S.G.PANDIT ORAL ORDER This review petition is filed under Order 47 Rule 1 of CPC praying to review the order dated 10.01.2025 in W.P.No.36322/2019 whereunder, petitioner’s challenge to order of termination dated 05.07.2017 (Annexure-K) is rejected holding that the termination is not attached with any stigma. - 3 - HC-KAR NC: 2026:KHC:21193 RP No. 123 of 2025 2. Heard Sri.Subramanya Bhat, learned counsel for the petitioner. 3. Learned counsel Sri.Subramanya Bhat would submit that a co-ordinate Bench in W.P.Nos.43037- 43041/2015 (H.M.KOTRESH AND OTHERS v/s THE STATE GOVERNMENT OF KARNATAKA AND OTHERS) and connected writ petitions (Annexure-B) disposed of on 31.08.2020 held that, for termination attaching stigma, enquiry would be necessary. Therefore, he submits that in the case of petitioner herein, no enquiry is conducted, hence termination is bad and requires interference. Hence, he prays for review the order dated 10.01.2025 and to direct the respondents to conduct enquiry before terminating the petitioner. 4. When this Court has specifically come to the conclusion that the order of termination is not attached with stigma, the judgment relied upon by the learned counsel for the petitioner in H.M.KOTRESH (supra) would have no application.
