This is an application for quashing of the proceedings in ACGR No. 513 of 2019, arising out of Purba Jadavpur Police Station Case No. 07 of 2019, dated February 7, 2019, under Sections 341/323/509/114/354B of the Indian Penal Code, presently pending before the learned 8th Judicial Magistrate, Alipore, South 24 Parganas. It is the specific defence of the petitioner that, on the date of the alleged incident, he was attending his regular classes at the Eastern Institute for Integrated Learning in Management, Kolkata. In support of his submission, reliance has been placed upon certain information obtained under the Right to Information Act, 2005, from Vidyasagar University, Midnapore, West Bengal, to which the said institute is affiliated. 2 It appears that the alleged place of occurrence is at Buderhat, Nayabad, Kolkata- 700094, whereas the institute is situated at 6, Waterloo Street, Kolkata-700029. Whether such plea of alibi can be established or not is a matter to be adjudicated at the trial. This Court is, therefore, not inclined to delve into the said issue at this juncture. Accordingly, CRR 1916 of 2025 is dismissed. Needless to clarify, the dismissal of this revisional application shall not preclude the petitioner from urging all the points available to him at the appropriate stage of the proceedings. The personal appearance of the Officer-in-Charge of Purba Jadavpur Police Station is dispensed with. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Kausik Chanda, J.)
