Side), For R1 And R2 https://www.mhc.tn.gov.in/judis CRL OP No. 15657 of 2026 __________ Page2 of 5 ORDER This Criminal Original Petition has been filed seeking a direction to the Special Court for Exclusive Trial of SC and ST Cases, Tiruvarur District, to consider the petitioners’ bail application sympathetically and pass orders on merits on the same day of their surrender, in connection with Cr.No.52 of 2026, pending on the file of the respondent police. 2. Heard the learned counsel for the petitioners, and the learned Government Advocate (Crl. Side) for the respondents 1 and 2. 3. The case of the prosecution is that the de facto complainant belongs to a Scheduled Caste community. The petitioners and the de facto complainant are residents of the same Village. It is alleged that the petitioners prevented the de facto complainant’s group from performing pooja and interfered with their right to worship in the Temple. The prosecution further alleges that the petitioners’ group erected a fence around a common pond and did not permit the de facto complainant’s group to use the same. When the de facto complainant’s group questioned such actions, the petitioners allegedly threatened, assaulted, and abused them by using case-based derogatory words. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in the present case. 5. In view of the above factual position, there shall be a direction to the Special Court for Exclusive Trial of SC and ST Cases, Tiruvarur District to consider the petitioners’ bail application, preferably on the same day of their surrender, in connection with Crime No.52 of 2026 on the file of the respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order. 6.
