The petitioners are before this Court seeking the following prayers:
"Wherefore, it is most humbly prayed that this Hon'ble Court be pleased to: A) Issue an appropriate writ, order or direction Quashing the following:

i. Complaint lodged by the 2nd Respondent on 09.01.2026 before the 1st Respondent (Annexure - A); and
ii. FIR in Crime No.0012/2026, registered by the 1st Respondent (Ashok Nagar Police) dated 09.01.2026 for offences punishable under Sections 66(c) and 66(d) of the Information Technology Act, 2000 and Sections 85, 351(2), and 352 of BNS, 2023, pending on the file of the XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru. (Annexure - A1). B) Pass any other order, writ or direction as may be deemed just and necessary in the
facts and circumstances of the case, in favour of the Petitioner, to meet the ends of Justice."
2. Heard Sri.Sharath S. Kulkarni, learned counsel for Sri.Arun Govindraj,
learned counsel appearing for the petitioners, Smt.Deepthi Alva, learned HCGP appearing for respondent No.1, Sri.Rishab Raj Thakur learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo in that regard, which reads as follows:
“The Petitioner No.1 and Respondent No.2, submit as follows:
1. The above-captioned petition has been filed by the

Petitioners seeking quashing of the complaint dated 09.01.2026 lodged by the 2nd Respondent and the consequent First Information Report registered by the 1st Respondent in Crime No.12/2026 for the offences punishable under Sections 66(c) and 66(d) of the Information Technology Act, 2000, and Sections 85, 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023. 2. Petitioner Nos.2 and 3 are the parents of Petitioner No.1, while Petitioner No.4 is a common friend of Petitioner No.1 and Respondent No.2. 3. Petitioner No.1 had instituted proceedings against Respondent No.2 seeking dissolution of their marriage in M.C. No.391/2026. Petitioner No.1 had also instituted proceedings in G&WC No.10/2026, seeking to declare him as the sole and permanent guardian and custodian of their minor son, namely, Rumi Rai. 4. During the pendency of the aforesaid proceedings, Petitioner No.1 and Respondent No.2 have amicably resolved all their matrimonial and other disputes and differences. Pursuant thereto, the parties have voluntarily entered into Memorandum of Settlement in M.C. No.391/2026 and G&WC No.10/2026, respectively. 5. In terms of the settlement arrived at between the parties, the proceedings in M.C. No.391/2026 and G&WC No.10/2026 have been disposed of by the competent Court on 25.08.2026. 6. As per the terms and conditions of the Memorandum of Settlement entered into in M.C. No.391/2026, the marriage between Petitioner No.1 and Respondent No.2 has been dissolved. The parties have also agreed to withdraw and/or not pursue the allegations, claims and allegations made against each other and against their respective family members in the all proceedings initiated between them. Further, the 2nd Respondent has agreed and undertaken to extend her cooperation to the Petitioners and has consented to the quashing of the aforesaid FIR in the present petition. 7.
Respondent No.2 states that all disputes and

differences that had arisen between her, Petitioner No.1 and his family members have been amicably resolved. Respondent No.2 further states that she has no subsisting grievance, claim or allegation against Petitioner No.1 or the other Petitioners in relation to the subject matter of the complaint and the proceedings arising out of Crime No.12/2026. 8. Respondent No.2 further states that, in view of the amicable settlement between the parties, she does not intend to prosecute or pursue the complaint lodged by him, insofar as the same relates to the Petition. WHEREFORE, it is humbly prayed that this Hon'ble Court may be pleased to quash the Complaint dated 09.01.2026 (Annexure A) and the consequent FIR registered in Crime No.12/2026 by the 1st Respondent for the offences punishable under Sections 66(c) and 66(d) of the Information Technology Act, 2000, and Sections 85, 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023 (Annexure - A1), in the interest of Justice and Equity.”
4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of the Joint Memo being filed and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioners in the subject petition. 6. ORDER [I] Petition is disposed. [II] Complaint lodged by 2nd respondent on 09.01.2026 before 1st respondent stands quashed qua the petitioners. [III] Proceedings in Crime No.12/2026 pending before the XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru, stands quashed qua the petitioners.
