Petitioner was appointed as Constable in Civil Police in the year 1998. Thereafter, he was transferred to Armed Police. In this writ petition, he has challenged the order passed by Disciplinary Authority on 12.07.2021 and the order passed by Appellate Authority on 22.12.2021. The Disciplinary Authority had imposed punishment of reduction to the initial pay scale for three years. The departmental appeal filed by the petitioner against punishment order was dismissed by the Appellate Authority. 4. Learned State Counsel submits that petitioner has statutory remedy of filing revision under Rule 23 of U.P. Police Officers of the Subordinate Ranks (Punishment and Appeal) Rules, 1991 against the order passed by Disciplinary Authority. Learned State Counsel further submits that under the Police Act, 2007, the Police Officers of Subordinate Rank have only one remedy of appeal against order of Disciplinary Authority, however, since petitioner was initially punished in 2005 for a misconduct, which was allegedly committed by petitioner before enforcement of Uttarakhand Police Act, 2026:UHC:1863 therefore, petitioner has the remedy of revision under the 1991 Rules. 5. In such view of the matter, the writ petition is disposed of with liberty to the petitioner to file revision petition before the competent authority. If he files revision within fifteen days from today, the same shall be heard and decided on merits.
