The petitioners are apprehending their arrest in connection with Complaint Case No.202 of 2021, for offence registered under section 33 of the Indian Forest Act, pending in court of learned Additional Chief Judicial Magistrate, Chatra.

Learned counsel for the petitioners submits that false allegations are made that the petitioners were cultivating poppy plants in the forest land and he next submits that the petitioners have got no criminal antecedent as disclosed in paragraph no.18.
4. Learned State counsel opposes prayer and submits that allegation is there of cultivating poppy plants in forest land.
5. Considering that the land is of the forest department and is not belonging to the petitioners and the petitioners have got no criminal antecedent as aforesaid, and in that view of the matter, the petitioners, above named, are directed to surrender before learned court within two weeks from today, and learned court shall release petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. A.B.A. No.1101 of 2026 is disposed of.
