Case No.596 of 2025 dated 21.05.2025 under Sections 126(2)/115(2)/118(2)/109/3(5) of the BNS, 2023. And In the matter of: Mansarul Hoque @ Mensarul Sk … petitioner Md. Wasim Akram … for the petitioner Mr. Soumik Ganguly Ms. Trisha Rakshit ... for the State Report filed by the State is taken on record. It appears from the report that Menarul is the same person as Mansarul Hoque @ Mensarul Sk. Learned counsel for the petitioner submits that the present petitioner has been falsely implicated in this case. The principal accused was arrested and thereafter granted bail. Charge-sheet has been submitted. Learned counsel for the State opposes the prayer for anticipatory bail, relies on the case diary and refers to the injury report present at pages 7 to 11 of the case diary and the statements of witnesses including independent local ones as also to the injured victim. He submits that the present petitioner has three criminal antecedents. 2 Considering the incriminating materials available in the case diary including the statements of witnesses pointing to the guilt of the petitioner, the injury report showing infliction of serious injury on vital part of the body like head and the criminal antecedents of the petitioner, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
