1. Petitioner seeks anticipatory bail in case arising out of FIR No.106 dated 15.07.2026, under Sections 3, 13(1) of The Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, Police Station Uttarwar, District Palwal, Haryana. This is the first petition for anticipatory bail.
2. While issuing notice of motion on 10.08.2026, following order was passed:-
“………. The FIR alleges that on 15.07.2026, on secret information received regarding petitioner preparing to slaughter a cow in his shed, the police party raided house of the petitioner and found a cow tied inside the shed with its legs tied with a rope. The petitioner, however, fled with the slaughtering tools when he saw police vehicle arrive. The Cow tied with rope was recovered.

Learned counsel for the petitioner submits that the house in question where raid was conducted did not belong to petitioner, who had been falsely implicated. Recovery had already been effected and custodial interrogation of the petitioner was not required. He further submits tha though there were five criminal cases earlier registered against the petitione he had been acquitted in all four cases and only case under Section 174( was pending, wherein he was on bail. Petitioner was ready and willing join investigation. Notice of motion. Mr. Vikas Bhardwaj, AAG Haryana, who is present in the Court accepts notice on behalf of respondent-State and opposes the prayer for anticipatory bail in view of antecedents of the petitioner. He further submits that petitioner absconded from the spot with tools for slaughtering and slaughtering tools were yet to be recovered. In the given facts and circumstances of the case, in the event of arrest, petitioner shall be released on interim anticipatory bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting/Investigating Officer. Petitioner shall join investigation as and when called upon to do so and shall abide by the conditions as envisaged under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. Status report in the matter be filed on 10.09.2026.”

Learned State counsel concedes that petitioner did join investigation pursuant to order of the Court, however, he opposes the prayer for anticipatory bail on the ground that he failed to get recovered the axe with which he was planning to slaughter the cow. 4. Pursuant to order of this Court dated 10.08.2026, petitioner has joined investigation. Benefit of anticipatory bail cannot be denied for the reason that the axe was not got recovered. Whether or not the axe was indeed taken away by the petitioner, would be a matter of trial. Considering all relevant facts and circumstances, the petition is allowed and order dated 10.08.2026, granting interim anticipatory bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023. 5. Pending miscellaneous applications, if any, stand disposed of.
