Accused in Crime No.205/2026 registered by Tumakuru Town Police Station, Tumakuru, for the offences punishable under Sections 115(2), 118(1), 351(2), 352 of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.205/2026 was registered by Tumakuru Town Police Station, Tumakuru, for the aforesaid offences against the petitioner herein based on the first information dated 06.07.2026 received from M.C.Raveesh S/o late Chikkannaiah. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.1048/2026 before the jurisdictional Sessions Court, which was rejected on 06.08.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that suit in O.S.No.359/2015 is pending before the jurisdictional Civil Court at Tumakuru, in which the petitioner is the plaintiff. It appears that first informant in the present case is appearing - 3 - HC-KAR CNR: KAHC010566252026 NC: 2026:KHC:47884 CRL.P No. 12625 of 2026 for defendant no.2 in the said suit. The incident in question had taken place after the aforesaid suit was called out and the parties had come out of the court hall. According to the learned Counsel for the petitioner, since the petitioner had not responded for the proposed settlement by the defendants, there was altercation and scuffle between the petitioner and the first informant, and therefore, a case and counter case was registered. The material on record would go to show that, petitioner's wife also has approached the police alleging that first informant in the present case had assaulted her husband on the alleged date of incident and her husband had suffered injuries and was admitted in the hospital. The wound certificate of the first informant in the present case would go to show that he had suffered only simple injuries in the incident in question. Petitioner is a senior citizen aged 67 years having no criminal antecedents. He has undertaken to co-operate with the police for the purpose of investigation. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.205/2026 registered by Tumakuru Town Police Station, Tumakuru, for the offences punishable under Sections 115(2), 118(1), 351(2), 352 of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
