Order on Board 07.10
.2026
1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 178/2026 registered at Police Station Kotra Road, District Raigarh (C.G.), for the offence punishable under Sections 34(2), 36, 49(A), 59(A) of C.G. Excise Act and Sections 336 (4), 336(3), 340(2), 61(2), 275 of BNS.
2. Case of the prosecution, in brief, is that on 08.06.2026, secret information was received by the police that the applicants and co-accused Vinay Singh SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.10.07 14:17:29 +0530
2 were allegedly manufacturing and selling counterfeit liquor at the applicants’ residence at Village Dhanagar by affixing fake holograms and stickers on liquor bottles. Thereafter, a raid was conducted and 230.460 liters of liquor, fake holograms, empty containers and caps of various liquor companies were seized from the premises of the applicants and registered aforesaid offence against the applicants.
3.
Learned counsel for the applicants submits that both the applicants have one criminal antecedent registered in the year 2026 for commission of an offence punishable under Section 115(2) of the BNS; charge-sheet has already been filed, applicant No. 1 and applicant No. 2 are in jail since 09.06.2026 and 10.06.2026, respectively and 230.460 liters of liquor was seized from the possession of applicant No. 1, whereas containers and bottle utensils were seized from the possession of applicant No. 2. He would pray for grant of bail to the applicants.
4. On the other hand, learned counsel for the State would oppose the bail application. She would submit that there is one criminal antecedent against each of the applicants and a huge quantity of liquor was seized from their possession; therefore, the instant bail application deserves to be rejected.
5. I have heard learned counsel appearing for the parties and perused the case diary.
6. Having considered the facts and circumstances of the case, nature and gravity of the allegations levelled against the present applicants and the fact that the charge-sheet has already been filed, applicant No. 1 and applicant No. 2 are in jail since 09.06.2026 and 10.06.2026, respectively, 230.460 litres of liquor was seized from the possession of applicant No. 1, whereas
3 containers and bottle utensils were seized from the possession of applicant No. 2. Further, the applicants have no criminal antecedents of similar nature; therefore, I am inclined to allow this application.
7. Accordingly, the regular bail application is allowed and it is directed that in the event of the applicants executing a personal bond for a sum of Rs.50,000/- each with one surety in the like sum to the satisfaction of the concerned trial Court, they shall be released on bail on the following conditions:- (i) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) they shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) they shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
