1. This Court has considered the detailed report of the Additional District & Sessions Judge, Fast Track Court, Rampurhat, Birbhum dated 26.02.2026. The examination of the witnesses for the purpose of ascertainment of the age of Nabatul Sk. has also been considered.
2. Having regard to the above, this Court is inclined to accept the detailed report dated 26.02.2026 comprising in about 22 paragraphs whereby the Trial Judge has come to the conclusions that the appellant, Nabatul Sk. was 15 years and 9 days as on 27.02.2011 i.e. the date and time of occurrence.
3. Since a juvenile cannot be convicted for more than 7 years and the said Nabatul Sk. having served more than 14 years of incarceration, the appellant, namely, Nabatul Sk. shall be set at liberty, if not wanted in any other case.
4. The bail bonds furnished by the appellant, namely, Nabatul Sk. shall stand cancelled and discharged.

5. In view of the above, CRA 146 of 2013 is disposed of. Consequently, all connected pending applications, if any, are also
disposed of.
6. The Trial Court Records, if any, along with copy of this
judgment be sent down to the learned Trial Court for necessary compliance.
7. An accommodation is sought for on behalf of the learned counsel for the appellant.
8. List this matter in the Monthly List of April 2026.
