For Petitioner(s) : Mr. Ravikar Patel, Advocate For Resp/State : Mr. Ghanshyam Kashyap, Dy. GA For Resp No. 5 in WPS No. 4087/2026 : Mr. Rajkumar Gupta, Advocate For Resp No. 5 in WPS No. 3955/2026 Mr. J.N. Nande, Advocate (HON’BLE SHRI JUSTICE BIBHU DATTA GURU)
Order on Board 05/10/2026
1. Since the writ petitioner is common in both the writ petitions and the
facts involved therein are interrelated, both the petitions are being heard together and are being disposed of by this common order.
2. The petitioner in WPS No. 4087/2026 is aggrieved by the inaction on the part of respondent No.5 in withholding the GPF amounts bearing Account Nos. CPO/602134 and GO-PBST0226089, amounting to Rs.10,64,052/-, on account of a purported negative balance of Rs.24,08,973/- in his GPF account with a prayer to release the aforesaid amount.
3
3. WPS No. 3955/2026 has been filed by the petitioner challenging the
order dated 17.04.2026 (Annexure-P/4 and P/5), whereby recovery of an amount of Rs.24,08,973/- has been directed from the petitioner on account of the negative balance shown in his GPF account.
4.
Learned counsel appearing for the petitioner submits that the petitioner retired from service on 31.12.2025 and that, subsequent to his retirement, the impugned recovery order has been passed and his GPF amount has been withheld. It is contended that such action is arbitrary, illegal and violative to Article 14 of the Constitution of India.
5. Per contra, learned counsel appearing for the State as well as respondent No.5 submit that, on account of the negative balance reflected in the GPF account of the petitioner, recovery of the aforesaid amount has been directed. It is further submitted that the grievance raised by the petitioner involves disputed questions of fact. Learned counsel submits that the State Government has constituted a High Power Pension Redressal Committee, in which representatives of the Accountant General are also members. It is, therefore, submitted that the matter may appropriately be referred to the said Committee for consideration and decision in accordance with law.
6. I have heard learned counsel appearing for the parties and perused the material available on record.
7. Having considered the submissions made by learned counsel for the parties and having regard to the nature of the dispute involved, the writ petitions are disposed of with a direction to the petitioner to furnish a copy of the writ petitions along with all relevant documents before the Office of the
4 Advocate General within a period of one week from today. Upon receipt thereof, the Office of the Advocate General shall forward the same to the High Power Pension Redressal Committee within a further period of 15 days. Thereafter, the Committee shall consider and decide the grievance of the petitioner with regard to the amount withheld from his GPF account as well as the recovery directed pursuant to the impugned order, in accordance with law. The petitioner and all other concerned parties shall be afforded an opportunity of hearing before taking a decision. The Committee shall thereafter pass a reasoned and speaking order, preferably within a period of 30 days from the date of receipt of the matter.
8. With the aforesaid observations and directions, both the writ petitions stand disposed of.
