1 CGHC010335412026 2026:CGHC:42979 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 8325 of 2026 Ravi Netam S/o Naresh Netam Aged About 40 Years R/o Kaneri Maneripara P.S. Purur Distt. Balod Chhattisgarh ... Applicant versus State Of Chhattisgarh Through The Station House Officer, Police Station Purur, Distt. Balod Chhattisgarh ... Non-Applicant For Applicant : Shri Jitendra Shukla appears on behalf of Shri Vipin Tiwari, Advocate. For Non-applicant/State : Ms. Ankita Shukla, Panel Lawyer (HON’BLE SHRI JUSTICE RAKESH MOHAN PANDEY) Order on Board 05/10/2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 61/2026 registered at Police Station Purur, District Balod (C.G.), for the offence punishable under Sections 20 (b) (ii) (B) read with Section 8 of the Narcotic Drugs and Psychotropic Substances Act (for short, the NDPS Act) against the present applicant. 2. The case of the prosecution, in brief, is that on 28.05.2026, the Police on the basis of secret information, intercepted the applicant and co- accused Amit Korram and their motorcycle bearing registration No.CG- 24-K-0170 and after search, seized 12.200 kilograms of contraband Digitally signed by ALLENA ANJANI KUMAR Date: 2026.10.06 10:37:34 +0530 2 ganja, which was being transported by the present applicant and co- accused for selling the same. Thereafter, the police completed investigation in accordance with the provisions of NDPS Act and registered offence against the applicant, as stated above. 3. Learned Counsel for the applicant would submit that the applicant has 8 live criminal antecedents, which were registered under the various provisions of BNS and Excise Act and NDPS Act and the same are pending consideration; charge-sheet has already been filed; the applicant is in jail since 28.05.2026 and further, conclusion of the trial is likely to take some considerable time. Therefore, he would pray that the application may be allowed and she may be enlarged on bail. 4. On the other hand, learned counsel for the State would oppose the bail application and argue that the applicant and other co-accused person were transporting the contraband ganja illegally on a motorcycle. It is also submitted that the police searched and seized total ganja weighing 12.200 kilograms from the possession of the present applicant and co-accused and further, there are total 8 live criminal antecedents, which were registered under the various provisions of BNS, Excise Act and NDPS Act and the same are pending consideration, therefore, the present applicant is not entitled for grant of regular bail in the present case. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. In the present bail application, the applicant has disclosed 8 live criminal antecedents under the various provisions of BNS and Excise 3 Act, pointing out that the same are pending consideration. Nonetheless, the primary objectives of examining an accused person's criminal antecedents during bail proceedings are: • To assess the likelihood of compliance with bail conditions and ensure the accused will not flee or jump bail; • To determine whether there is a habitual pattern of committing similar or grave offenses; and • To evaluate the risk of evidence tampering, obstruction of the ongoing investigation, or witness intimidation. The existence of 8 live pending criminal antecedents under various provisions of BNS and Excise Act underscore a persistent pattern of offending, raising a grave apprehension of offense repetition if he is enlarged on bail. 7. Also in light of the judgment rendered by the Supreme Court in Deepak Yadav v. State of Uttar Pradesh & Another, reported in (2022) 8 SCC 559, wherein the Hon'ble Supreme Court had cancelled the bail granted to the accused therein on the ground that the accused had previous antecedents, this Court is not inclined to extend the benefit of bail to the applicant. 8. Accordingly, the instant bail application is rejected. Sd/- (Rakesh Mohan Pandey) JUDGE Anjani
