Petitioner had filed an application before Respondent No.2- Sub-Divisional Tahsildar, Bangalore South Taluk seeking grant of genealogy of his family consisting of 11 members. The said application came to be rejected by respondent No.2 vide endorsement dated 27.12.2021 as per Annexure-F on - 3 - the premise of petitioner not furnishing documents with regard to address proof of his family members as well as the death certificates of the demised members of his family. 2. Being aggrieved, petitioner had preferred an Sakala Appeal No.2/2021-22 before the respondent No.3-Assistant Commissioner, Bangalore South Sub-Division, Bangalore, who by order dated 25.03.2022 rejected the said appeal confirming the order passed by the respondent No.2- Tahsildar. Being aggrieved, the petitioner is before this Court. 3. Learned counsel for petitioner submitted that the respondent- Authorities were not justified in declining to issue genealogy of family of the petitioner merely because the ancestors and other family members of the petitioner were residing in different jurisdictions, when admittedly grandparents, parents, aunt and three of his unmarried sisters had died and he had produced death certificates of all the deceased family members and that only the petitioner and his sister were residing within the jurisdiction of the respondent authorities. As such, the impugned orders were unsustainable. Hence sought for quashment of the same. - 4 - 4. In response learned AGA submitted that the respondent No.2-Tahsildar and respondent No.3-Assistant Commissioner are justified in declining to issue the genealogy inasmuch as the petitioner has not furnished proof of address of the family members residing within their jurisdiction. That according to the enquiry conducted upon the application filed by the petitioner, barring few, nine of the members were found to be not the residents of the concerned jurisdiction/village and they were residing at different jurisdiction/villages namely Kalasipalya, R.R.Nagar, Doddenakundi etc. As such, no fault can be found with the order passed by the respondent-Authorities. Hence seeks for dismissal of the petition. 5. After hearing the learned counsel for petitioner and the learned AGA, this Court had sought for clarification from the learned counsel for the parties with regard to specific provision of law providing for issuance of Genealogy/Family Tree/survivors certificate. No specific provision of law is brought to the notice of this Court governing the question pertaining to issuance of such certificates. - 5 - 6. However, it appears that respondent-State Government from time to time has been issuing circulars laying down the guidelines for issuance of such certificates. Such circulars are dated 20.03.2014, 06.08.2014, 10.09.2018 and 17.07.2026. Appropriate to extract contents of the said circulars for easy reference. Relevant to note that an Act known and called as the Karnataka Sakala Services Act, 2011 has been promulgated for the purpose of providing guarantee of services to the citizens in the State of Karnataka within stipulated time limit ಕಮ ಸಂ(ೆ@ ಅC:%ಾರನ 3ಾಗೂ ಕುಟುಂಬದವರ 3ೆಸರು ಮತು- ವಯಸುˆ ಅC:%ಾರ kೊಂ<Sೆ ಸಂಬಂಧ ಗುರು,ನ [ೕe ಮತು- ಸಂ(ೆ@ ವ@AಾUಕ (ಅAಾUತ/AಾUತ/ ಧವ/ಧುರ/qೆ–ೕದನ ಪMೆದವರು) 1 2 - 16 - and matters connected therewith and incidental thereto. List of services, designated officer, stipulated time, competent officer, time limit for disposal by competent officer, appellate authority and time limit for disposal of appeal are enlisted in the schedule to the said Act. In that under the heading `Revenue Department' at Sl.No.16 there is a reference to "Surviving Family member Certificate". The Tahsildar is the designated officer for issuance of such certificate. Time stipulated is seven working days competent officer is "Upavibhagadhikari", time period is 15 days. Appellate authority is "Jilladhikari", time period is 15 days. 8. Except this there is no other reference in any statute, providing any provision of law for issuance of Genealogy/Family Tree/survivors certificate. 9. What then, would be the purpose and requirement of a person like that of petitioner seeking issuance of Genealogy/Family Tree/survivors certificate to undergo the procedure contemplated under the aforesaid circulars in the absence of any specific law or the statute providing therefor? 10. Answer to the above question would lie in the following. Generally, Genealogy/Family Tree/survivors certificate is - 17 - sought to be furnished upon the demise of an ancestor/family members for the purposes namely; (1) mutation of names of the legal heirs of the deceased ancestor/family members in the revenue records pertaining to immovable property/estate of the deceased ancestor; (2) to avail the benefits accrued to the account of the deceased ancestor/family members receivable from his employer; (3) to receive any benefit from any authorities concerned; (4) Property transactions; (5) Suits for partition; (6) Claim for compensation; (7) Any administrative purposes etc. 11. 11. These kind of Genealogy/Family Tree/survivors certificate are issued upon the information furnished by the surviving legal heirs of the deceased ancestor/family members. Issuance of these certificates by the revenue authorities is more of a practice than the requirement of law. It is only for the purpose of verifying the authenticity of information - 18 - furnished by the person seeking such certificates. The revenue authorities/officer, such as Village Accountant or the Revenue Inspector of the local area where the deceased last resided, are expected to be aware of the details of residents within their area of operation. Therefore generally a formal local enquiry ensuring the information furnished by the applicant is authentic and true is conducted by concerned revenue officer namely the Village Accountant or the Revenue Inspector as the case may be from the neighbors and locals of the applicant to ensure information furnished in the application seeking issuance of such certificate is true and authentic. 12. This however, does not mean that the respondent authorities would be justified in rejecting the application merely on the premise that the members whose names are mentioned therein so furnished by the applicant are not residing within the jurisdiction of the concerned revenue officer. Reasons for the descendants/family members staying at different places could be various. 13. Issuance of Genealogy/Family Tree/survivors certificate cannot be equated to issuance of a residential certificate in - 19 - which case requirement of the person seeking such certificate, residing within the local jurisdiction of the authority concerned for a prescribed period may be imperative. This is for the reason that the residential certificate would be required for the purpose of obtaining employment, benefit under the Government schemes, which are designed to cater to the legal requirements. 14. Therefore, reason to reject the application for issuance of Genealogy/Family Tree/survivors certificate merely because descendants of the deceased/or members of the family are residing at different places cannot be countenanced. It should be remembered that the genealogy stems from original ancestor and place of his/her permanent abode prior to the demise must be the determining factor. It would therefore be sufficient if persons claiming to be the descendants/legal representatives of the deceased ancestor/family members who were residing within the jurisdiction of the concerned revenue officer for the purpose of issuing the Genealogy/Family Tree/survivors certificate. It is for this minimal purpose a formal enquiry by the concerned revenue officer is contemplated. If there are no objections or disputes found during the local - 20 - inspection/enquiry by the revenue authorities declining to issue such certificates would be arbitrary. 15. In any event person furnishing the information would be primarily responsible for the consequences arising therefrom. Merely because such certificates are issued, the same do not carry substantive evidentiary value. Should there be any dispute with regard to the claim of legal heirship or claim of legal representatives such disputes are required to be adjudicated and determined only by a Civil Court of competent jurisdiction and admissibility of such certificates, are however subject to proof of contents of the same, as provided under the provisions of the Indian Evidence Act now Bharatiya Sakshya Adhiniyam, 2023. The circulars extracted hereinabove may therefore only be read as a guiding factor and not beyond. 16. For the aforesaid reasons and analysis, following: ORDER 1. Writ petition is allowed. - 21 - 2. Impugned order dated 27.12.2021 at Annexure-F passed by respondent No.2-Tahsildar and order dated 25.03.2022 at Annexure-E passed in SAKALA APPEAL No.02/2021-22 by respondent No.3-Assistant Commissioner are hereby quashed. 3. Respondent-Tahsildar is directed to issue certificate subject to petitioner furnishing the details as per the circular dated 17.07.2026 noted above as expeditiously as possible as contemplated under the Karnataka Sakala Services Act, 2011.
