Applicant versus State of Chhattisgarh Through Police Station - Nawagarh, District – Janjgir - Champa (C.G.) ... Non-applicant For Applicant : Mr. Nishant Basak, Advocate on behalf of Mr. Ashutosh Trivedi, Advocate. For Non-applicant/State : Mr. Vivek Sharma, Panel Lawyer. Hon’ble Mr. Rakesh Mohan Pandey, Judge Order on Board 06.10.2026 1. This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 83/2026 registered at Police Station : Nawagarh, District – Janjgir - Champa (C.G.) for the offence punishable under Sections 137(2), 65(1), 87 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (for Short POCSO Act). 2. The prosecution case, in brief, is that the main accused Sandeep Tandan allegedly established physical relations with the minor victim on the KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 promise of marriage. Thereafter, on 28.02.2026, he telephonically informed the victim that he would marry her and that his father, co- accused Polaram Tandan and the present applicant Ravi Kosle would come to take her. Accordingly, on 01.03.2026, co-accused Polaram Tandan and the present applicant allegedly went to the village of the victim, who was aged about 14 years and 5 months, and took her away from the lawful guardianship of her parents with the alleged intent to compel or induce her to have illicit intercourse. Accordingly, Crime No.83/2026 was registered at Police Station Nawagarh for the aforesaid offences and the applicant was arrested on 11.03.2026. 3. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated due to political rivalry and personal vendetta arising from his election as Ward Member and his previous complaint against the victim's family regarding alleged illegal sale of liquor. He would further submit that the principal allegations are against co-accused Sandeep Tandan and there is no cogent material showing the applicant's involvement in the alleged kidnapping or other offence. He would submit that the applicant is a Ward Member of Ward No.3, Nagar Panchayat, Nawagarh, has no criminal antecedents and has remained in custody since 11.03.2026. The conclusion of the trial is likely to take some time. Therefore, he prays for grant of regular bail to the applicant. 4. Learned State counsel opposes the bail application and submits that the applicant is alleged to have actively participated in taking away the minor victim, aged about 14 years and 5 months, from the lawful guardianship of her parents along with co-accused Polaram Tandan. He submits that the allegations are serious in nature and that the material collected during 3 investigation prima facie establishes the involvement of the applicant in the alleged offences. Accordingly, he prays for rejection of the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Having considered the facts and circumstance of the case, submissions made on behalf of the parties, nature of the allegations and the material available on record, this Court finds that the principal allegation of having established physical relations with the minor victim on the promise of marriage is directed against the main accused, namely, Sandeep Tandan. So far as the present applicant is concerned, his alleged role is confined to having accompanied co-accused Polaram Tandan in taking the victim from her village and there is no specific allegation that the applicant himself had established any physical relationship with the victim or had induced her by making any promise of marriage. The applicant has no criminal antecedents and has been in custody since 11.03.2026 thus, without expressing any opinion on the merits of the case, I am inclined to grant bail to the applicant. 7. Accordingly, the bail application of the applicant is allowed. It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; 4 (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.he shall appear b dte given to him by the said Court till disposal Sd/- (Rakesh Mohan Pandey) Judge Kunal
