In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with S.T. 01(02) 26, NDPS 29 of 2025 arising out of Hatishala PS Case No. 107/25 dated 21.05.2025 u/s 20(b)(ii)(c)/29 of the NDPS Act.
-And-
In the matter of : Subhan Miya @ Subham Miya @ Suban Miah
… Petitioner(s)
Mr. Angshuman Chakraborty Mr. S. S. Saha
… for the Petitioner(s)
Mr. Indradip Das Mr. K. Manna
… for the State-respondent(s)
The petitioner is in custody for more than one year three months and has been implicated as the petitioner was plying a taxi and from the dicky of the said vehicle 47.400 kg of ganja have been recovered. Learned advocate for the State opposes the prayer for bail. I have taken into account the quantum of seizure in the present case. Having regard to the same, I am of the view that the rigors of Section 37 of the NDPS Act are attracted, as such, at this stage, I am not inclined to grant bail to the present petitioner.
2 Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1905 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
