The present petition has been filed by the petitioner with the following prayer: “It is therefore prayed that this Hon’ble Court may kindly be pleased to quash FIR dated 05.04.2023 (in Crime No. 032/2023, registered by Police Station Mahila Thana-Durg), the charge-sheet dated 20.09.2025 (filed by Police Station Mahila Thana- Durg), and quashing of criminal proceedings arising out of FIR No. 32 of 2023 registered under Sectio 498A IPC, Criminal Case No. RCC/33880/2025 are pending before the Court of Judicial Magistrate First Class, Durg, Chhattisgarh, Next hearing date 10.04.2026, in the interest of justice.” 3. Learned counsel for the petitioner submits that earlier the petitioner along with his mother had filed CRMP No. 849 of 2023 for quashing of the FIR and, vide order dated 17.08.2023, the matter was referred to the Mediation Centre of this Court. However, the mediation failed and thereafter, vide order dated 01.09.2025, the FIR bearing Crime No. 32 of 2023 registered at Mahila Thana, Durg was quashed to the extent of the mother of the petitioner, while the prosecution against the present petitioner/husband was directed to continue and be concluded expeditiously. 4. It is further submitted that now both the parties have amicably resolved their disputes and differences by mutual consent and have 3 executed a mutual settlement agreement on 06.11.2025 before the Public Notary, Dongargarh, District Rajnandgaon (C.G.), a copy of which has been filed along with the present petition. It is further submitted that pursuant to the said settlement, both parties jointly filed a petition for divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955, and the learned District Judge, Dongargarh has granted a decree of divorce by mutual consent vide judgment dated 13.11.2025, thereby dissolving the marriage dated 25.12.2022. 5. From the aforesaid mutual settlement agreement dated 06.11.2025, it is apparent that the petitioner and his wife have amicably settled their dispute and have decided to part ways. 6. In view of the aforesaid settlement arrived at between the parties, this Court is of the considered opinion that continuation of the criminal proceedings against the petitioner would serve no useful purpose. 7. Accordingly, the FIR bearing Crime No. 32 of 2023 dated 05.04.2023 registered at Police Station Mahila Thana, Durg, District Durg (C.G.) for the offence under Section 498A of IPC and all consequential proceedings arising therefrom, including Criminal Case No. RCC/33880/2025 pending before the Court of Judicial Magistrate First Class, Durg, are hereby quashed. 8.
