JUSTICE JAYANT BANERJI) A compliance affidavit has been filed today in Court by the learned AGA appearing for the accused. The compliance affidavit is sworn by Dr. Thrilokchandra K.V. serving as Secretary, Department of Planning, Programme Monitoring and Statistics. 2. It is stated that pursuant to the order of this Court, the claim of the complainant / petitioner was considered by the competent authority and after examining the entire matter and the records, a reasoned - 3 - HC-KAR CNR: KAHC010676092025 NC: 2026:KHC:48266-DB CCC No. 1336 of 2025 order dated 12.08.2026 was passed. Paragraph 5 reads as follows: “5. I state that after examining the entire matter and the relevant records, the competent authority has passed a speaking and reasoned order No.PDS/197/SMC.2025 Dated 12.08.2026 (Sri Yogeesh Naik K.R., driver (daily wages) Malenadu Area Development Board, after service as a driver (daily wages) driver for 10 years from 01.01.1995, that is, from 01.01.2005 onwards, the Malenadu Area Development Board has ordered to regularize his service in the post of driver) on the representation of the Petitioner. Copy of the proceedings of the Government Order dated 12.08.2026 along with English Translation is produced herewith as Annexure- R1.” 3. Apology and explanation is tendered in paragraph Nos.7 to 11 of the compliance affidavit. 4. We have perused the Government order that is enclosed as Annexure-“R1”. The operative part of the Government order reads as follows: “Government Order No. PDS/197/SMC/2025, Bengaluru, dated: 12/08/2026. In the background of the facts explained in the proposal, it is ordered by regularizing the service of Sri. Yogeesh Naik K.R., driver on daily wages basis in the post of Driver in the Malenadu Area Development Board, with effect from 01.01.2005, i.e., after he completed the service of 10 years as a Driver on daily wages basis from 01.01.1995. - 4 - HC-KAR CNR: KAHC010676092025 NC: 2026:KHC:48266-DB CCC No. 1336 of 2025 Since this case is considered in the background of the orders passed by the Hon’ble High Court and Supreme Court, the said case shall not be taken as an instance for any other cases.
